A Curry County couple has gone to court to challenge a state law that they claim makes it nearly impossible to hold errant herbicide spraying operations responsible for their mistakes, which includes spraying when it’s too windy which causes the chemicals to drift over other people’s property, or just missing their targets area altogether.
The couple claims that the Oregon State Constitution guarantees Oregon residents a remedy for injury to their person, property or their reputation. Only farmers and foresters seem to have this state legislatively imposed immunity. And they want it stripped from Oregon statutes.
